The Humanitarian and Compassionate Grounds program (H&C) makes an exception to the criteria while still operating within the confines of current immigration law, allowing those with extraordinary circumstances to apply for permanent residence status in Canada. Every application is considered on a case-by-case basis.
The government looks for those who have extremely compelling reasons for leaving their home country and settling permanently in Canada when evaluating applications under the H&C program. Threats to their physical and emotional health are one of these. Contrast the H&C program with the refugee program, which is for people escaping their place of origin due to persecution.
Most often, elderly parents who have no family, financial, or other ties to their country of origin and whose children and grandchildren reside permanently in Canada turn to the H&C program. Those who were turned down for immigration via the refugee program are also eligible for this program.
Once the candidate has been a resident of Canada for at least a year, they must submit the necessary paperwork for the H&C program. As a result, our strategy is first to have the applicant enter Canada with the requisite authorization (with a tourist visa or Super visa), after which we will give them a full explanation of our method and the reasons behind it. Lastly, we will provide them with the necessary papers.
