FAMILY AND SPOUSAL SPONSORSHIP

As a result of the Family Class Immigration and Spousal Sponsorship procedures being streamlined and having fewer requirements than other immigration streams, Canada understands the value of family and spousal assistance for its citizens and residents. The number of applications accepted annually is unrestricted by IRCC.


You can apply to sponsor your spouse, common-law partner, kids, parents, and grandparents if you are a citizen or permanent resident of Canada. Here is a list of initiatives aimed at bringing families back together. As long as you still complete all sponsorship conditions three years after sponsoring the first relative or group of relatives, you may sponsor further relatives: 

Spousal Sponsorship

A Canadian citizen or permanent resident can sponsor their partner for permanent residency under Canadian immigration rules. During the application process, the Canadian Citizen and the foreign national must be approved by Immigration, Refugees and Citizenship Canada (IRCC). 

Both parties must demonstrate that their relationship falls into one of three categories:


  • Spouse


  • Common-law Partner


  • Conjugal Partner


Same-sex partners may apply to the categories above as long as they fulfill all other requirements. The criteria for sponsors are as follows: 


  • The sponsor must be at least 18 years of age
  • The sponsor must be a Canadian permanent resident living in Canada or a Canadian citizen
  • The sponsor cannot be in prison, under a removal order, or charged with a serious offense
  • The sponsor cannot be bankrupt and is required to show proof of income or funds
  • If the sponsored person is 18 years of age and already lives with you, it must be proven with corresponding documentation (ex., bills, lease agreement, etc.)
  • The sponsor cannot have been sponsored to come to Canada within the last 5 years


  

The sponsored person must meet the following requirements:


  • The sponsored person must be at least 16 years of age


  • The sponsored person cannot be too closely related by blood to the sponsor


You must submit proof of your marital status, as well as receipts and bills demonstrating your cohabitation, with your application.

  

You cannot apply to be a sponsor under Spousal Sponsorship if:


  • You reside permanently outside of Canada
  • You are bankrupt, have unpaid debts from a family support payment, performance bond, or immigration loan
  • You have not taken care of a previously sponsored relative's basic necessities
  • You are detained by a court order, incarcerated, housed in a reformatory or prison, or both
  • You receive social assistance for a reason other than a disability
  • You were convicted of a violent or sexual offense, caused bodily harm, or threatened to commit any of these offenses
  • You intend to sponsor an inadmissible individual (someone who is a threat to Canadian society, has a criminal record, and has outstanding debts or warrants outside of Canada)

Dependent Child Sponsorship

The application form must list the dependent children of any partners you sponsor. The fact that Canadian nationals cannot be sponsored is quite crucial. Additionally, if you have children, they may already be Canadian citizens if born after you became a citizen.


  

An individual is considered a dependent if he or she:


  • Is under 22 years old and does not have a spouse or a common-law partner
  • Is over 22 years old but has not been able to support him or herself due to a physical or mental condition
  • Is over 22 years old but he or she has depended on their parents for financial support before turning 22


  

To sponsor a dependent, a Canadian or permanent resident must fulfill the following conditions:


  • The sponsor must be at least 18 years of age
  • The sponsor must be able to provide basic needs for him/herself and their family, if applicable
  • The sponsor must not be in prison, bankrupt, under a removal order, or be charged with a serious offense
  • The sponsor must be able to prove that the dependent is their biological or adopted child

Parents and Grandparents Sponsorship

You might want to bring your parents or grandparents with you once you have been a permanent resident or citizen of Canada for a while. There are numerous reasons why you should. If they are close by, you may spend quality time together as a family, tend to their needs, and let them help with the kids. Numerous studies have demonstrated that having close family members' support generally enables people to acquire jobs and improve their general well-being. Significant emotional value, however, also carries an enormous responsibility.

 

When a person sponsors their parents or grandparents to immigrate to Canada permanently, they must:


  • Having the required income (Considering the number of family members they will be accountable for, the minimum income requirement is computed as the Low-Income Cut-Offs (LICOs) + 30%.


  • Financially support the individual(s), i.e., they are not entitled to government aid and do not qualify for a retirement pension plan for 20 years beginning on the day they are granted permanent residency.

  

A sponsorship agreement, which must be signed by both the sponsor and the sponsored relative, states the following:


  • Makes the sponsor responsible for financial support for the sponsored relative
  • For a period of 3 to 20 years
  • Depending on their age and relationship to you
  • Beginning on the date they become a permanent resident
  • Clearly establishes that the person becoming a permanent resident will make every effort to support themselves by finding employment



The agreement cannot be signed by dependent children under the age of 19.


2018–2019 CHANGES

Due to the program's limited availability of slots each year and the fact that applicants were chosen through a lottery run by immigration officials, it was heavily criticized by the general public for not satisfying all applicants. Also, cybersecurity experts have regularly expressed concern about the lottery system's vulnerability and the potential for result manipulation.


The lottery's 2018 results exposed yet another serious issue. According to IRCC, a sizable portion of the applications needed to satisfy the required standards necessitated a second round of selections. The government agreed to raise the yearly quota for 2018 to 17,000 applications in response to public outcry. On August 20, 2018, the government announced the termination of the lottery and raised the annual quota to 20,000 applications in 2019 and 21,000 applications in 2020. Ahmed Hussein, former minister of immigration, claims that rather than choosing applicants randomly, the government will prefer those who submitted their applications first and completed all the requirements.


Before submitting your application, you must be confident that your parents or grandparents will undergo the required medical examinations and criminal background checks.
